南丰县一男子春耕时期销售伪劣农药获刑！造成损失44万！

box-sizing: border-box !important;'>法院经审理查明，被害人黄某某通过“一亩田”网站看到被告人王某某发布的销售农药的信息，于是向被告人王某某购买了陶氏益农大生牌“代森锰锌”、“毒死蝉”、“矿物油”、硼肥等农药。黄某某分三次将共计27840元货款转入被告人王某某银行账户。黄某某使用上述农药的农户发现农药未产生药效，即向南丰县农业局报案，南丰县农业局工作人员将黄某某在王某某处购买陶氏益农大生牌“代森锰锌”送湖南省化肥农药质量监督检验授权站检验，检验结论为“该样品经检验，所检项目不符合GB/T20700-2006标准要求，不合格”。经江西博中司法鉴定中心对使用上述农药的农户经济损失进行评估，被害人黄某某等农户在南丰蜜桔上喷施网购农药，造成经济损失评估总计人民币444480元。</span></p><section data-tools="135编辑器" data-id="105057" style='outline: 0px; visibility: visible; box-sizing: border-box !important;'><span style='outline: 0px; max-width: 100%; font-size: 16px; visibility: visible; box-sizing: border-box !important;'>法院审理认为，被告人王某某明知是假冒伪劣的农药，而予以销售，致使生产遭受共计人民币444480元的重大损失，其行为已构成销售伪劣农药罪。被告人王某某系初犯，归案后如实供述了自己的犯罪事实，系坦白，庭审中又自愿认罪，依法可以从轻处罚。案发后，被告人王某某亲属积极赔偿了被害人黄应龙等人的损失，被害人对王某某的行为表示谅解，请求对王某某从轻处罚，对其又可酌情从轻处罚。郑州市金水区司法局出具王某某具备适用社区矫正条件的意见，对被告人王某某适用缓刑不致再危害社会。法院遂依法作出如上判决。</span></p></section></section></section><section style='margin-right: 8px;
