color: rgb(255, 255, 255); padding: 7px 18px; transform: skew(10deg);'><strong data-brushtype="text">一、案件基本情况</strong></section></section></section><section style='display: flex;justify-content: flex-start;'><section style='width: 25px;height: 25px;border-bottom: 3px solid rgb(255, 207, 84);border-left: 3px solid rgb(255, 207, 84);overflow: hidden;'><br></section></section></section></section></section><section data-role="paragraph"><p><br></p></section><p style='text-align:justify;text-indent: 2em;line-height: 2em;'><span style='font-size: 16px;color: #000000;letter-spacing: 2px;'>凯升公司成立于2013年4月11日，公司类型为法人独资的有限责任公司，住所地位于南丰县琴城镇桔苑北路151号（凯升购物广场内），工商登记注册地在南丰县，该公司法定代表人为周爱根。投资人为浙江凯升控股集团有限公司，认缴出资1000万元，实缴出资1000万元。经营范围为商业项目设计、策划、开发咨询及管理、房屋租赁、物业管理等。申请人钟梅英与被申请人凯升公司租赁合同一案经本院作出（2022）赣1023民初221号民事判决书，确定凯升公司欠钟梅英10654元租金及违约金。判决生效后，凯升公司一直未履行判决确定的给付义务。钟梅英申请本院强制执行亦未得到清偿，遂向本院执行局提出破产重整申请。截止本院执行局作出（2022）赣1023执993号执行决定书时，已受理申请执行案件33件，执毕4件，未完全执行完毕29件，未执行到位金额约48万元及违约金。同时已经向本院申请执行但还未立案的执行案件共计108件，标的金额约225万元及违约金。同时，本院执行局查明，截止2023年3月，凯升公司相关民事诉讼案件共计454件，涉及金额约1100.837377万元。目前通过执行程序，冻结凯升公司账户资金7万余元，提取到租金1902249.97元（含担保人财产）。2023年4月3日，本院作出（2022）赣1023执993号执行决定，将被执行人凯升公司移送破产重整审查。2023年4月27日，本院作出（2023）赣1023破申5号民事裁定书，裁定受理申请人钟梅英提出的南丰县凯升商业管理有限公司重整申请。</span></p><p style='text-align:justify;text-indent: 2em;line-height: 2em;'><br></p><section data-role="title" data-tools="135编辑器" data-id="126507"><section style='margin: 10px auto;display: flex;justify-content: center;'><section style='transform: skew(-10deg);-webkit-transform: skew(-10deg);-moz-transform: skew(-10deg);-o-transform: skew(-10deg);'><section style='display: flex;justify-content: flex-end;'><section style='width: 25px;height: 25px;border-top: 3px solid rgb(255, 207, 84);border-right: 3px solid rgb(255, 207, 84);overflow: hidden;'><br></section></section><section style='background-color: #ffffff;margin: -20px 5px;'><section style='background-color: #54a0f7;'><section style='font-size: 16px;
