font-size: 16px; letter-spacing: 1.5px; padding-right: 10px; padding-left: 10px; box-sizing: border-box;"><p style="text-indent: 2.1875em; box-sizing: border-box;"><span style="box-sizing: border-box;">2023年4月27日，南丰法院根据债权人的申请裁定受理凯升公司破产重整案，6月2日通过竞聘方式指定江西帝经律师事务所和浙江达正律师事务所联合担任凯升公司管理人（以下简称管理人），8月22日，法院通过“破栗子”平台组织召开了凯升公司第一次债权人会议，会议表决通过了《南丰县凯升商业管理有限公司破产重整全面招募重整投资人及营业管理方案》，确认了凯升公司负债777笔，债权总额近5000万元，其中税款债权约5.8万元，普通债权约3703.8万元（其中欠付凯升业主返租租金2019.74万元），劣后债权约1289.34万元。2024年12月9日，管理人组织召开了第二次债权人会议，此次会议表决通过了破产财产分配方案，但重整计划未获表决通过。2025年5月9日，本院根据管理人的申请，依法宣告终结破产重整程序并宣告凯升公司破产，12月11日，本院根据管理人的申请，裁定批准《南丰县凯升商业管理有限公司破产财产分配方案》及实施细则，12月19日，管理人申请终结破产清算程序。法院经审查认为凯升公司破产财产已处置完毕，业主委员会已对凯升商场实施了接管和经营，管理人也承诺后续事宜将跟进办理，符合终结破产清算程序的法定条件，依法裁定终结凯升公司破产清算程序。</span></p><p style="text-indent: 2.1875em; box-sizing: border-box;">二、推进营商环境改革，多项工作举措创新。<strong style="box-sizing: border-box;">一是试行跨省联合管理人模式。</strong>本案涉及商场破产，在全市无先例可循，为提升破产审判质效，首次以“竞争+评审”方式遴选最优管理人，同时允许以联合申报方式引入外省管理人，成功选聘江西帝经律师事务所和浙江达正律师事务所担任联合管理人。履职其间，联合管理人发挥团队优势，以其专业素养，勤勉履职，赢得了债权人和法院信任。<strong style="box-sizing: border-box;">二是引入专业的破产审判服务提供商。</strong>首次与省外的破产审判服务专业服务商破栗子集团公司合作，债权申报、债权审查、会议通知、文书送达、债权人表决等环节全部通过“破栗子”破产案件一体化管理平台完成，充分高效地保障了债权人的知情权、参与权和表决权。第一次债权人会议，仅用时五十分钟便完成了全部既定议程，表决结果即刻可得。<strong style="box-sizing: border-box;">三是引入区块链存证技术。</strong>破产案件的全部电子数据同步保存在浙江省杭州市杭州互联网公证处，通过区块链存证生成电子存证确认函，确保司法审判数据安全。本案的审理为全市商业地产破产清算及营商环境改革提升提供了可复制的司法样本。</p><p style="text-indent: 2.1875em; box-sizing: border-box;">三、支持债务人继续经营，维护商场运营价值。本案凯升广场地理位置优越，在当地品牌影响力大，为尽量减少重整对商场经营的不利影响，法院指导管理人继续委托原有的商场运营团队维持正常运营，续聘必要的现场人员，同时全面落实习近平总书记对江西新余市渝水区一临街店铺火灾事故重要指示，高度重视商场安全，投入15万余元开展消防整改，全面做好日常安保、物业维护等工作。进入破产程序后，商铺业主情绪稳定，现有租户正常经营，商场经营实现破产不停摆。</p><p style="text-indent: 2.1875em; box-sizing: border-box;">四、发挥法院主导作用，促进府院联动同题共答。本案审理过程中涉及职工安置、资产处置、信访维稳、税务处理、商场经营风险防范等多方面问题。法院紧紧依靠党委领导、政府支持，与政府各职能部门共商共治，同题共答，先后召开12次协调会，解决水电、消防、人防和商场业主委员会选举、新物业公司成立等难题，破产期间未激化新矛盾，也无新的涉诉信访。</p><p style="text-indent: 2.1875em; box-sizing: border-box;">五、企业有序出清，地标商场焕新。党的二十届四中全会明确提出健全企业破产机制，完善企业退出制度；提出坚持促民生和促消费紧密结合，更好发挥消费拉动作用。本案中凯升公司作为轻资产运营的管理公司，无市场认可的重整价值，运用司法手段实现平稳有序出清；商场作为重要的居民消费场所，是带动周边商业发展和拉动消费的重要引擎，法院和管理人牢牢牵住商场运营这个“牛鼻子”，在破产程序中通过引导成立业委会，实现业主经营权自治，并成功招商，在破局中寻生机，使得凯升商场迎来新生。</p></section></section></section></section></section></section></section><p style="box-sizing: border-box;"><br style="box-sizing: border-box;"></p><section style="padding-right: 20px;
