南丰“完美证据”被打假，妨碍诉讼受处罚

15px;'>2021年1月10日，原告鄢某将一批蜜桔交由被告满某进行承运，在运输过程中，承运车辆无故自燃，货物尽毁。同年2月18日，鄢某向法院起诉要求被告满某等赔偿其损失135000。起诉的同时，鄢某向法庭提交了《水果购销合同》、《运输协议书》等证据。承办法官在查阅案卷时，发现《水果购销合同》中约定的南丰蜜桔价格为每市斤1.95元计算，该价格明显与南丰蜜桔市场行情并不相符。次日，承办法官通知鄢某和曾某就签订《水果购销合同》的情况进行“背靠背”询问。</span></p><p style='font-size: 14px;line-height: 1.75;font-family: 思源黑体;letter-spacing: 1px;text-indent: 2em;'><span style='font-size: 15px;'>询问前法官依法告知鄢某和曾某必须如实向法院陈述基本事实，如果虚假陈述或伪造证据，将依法追究相应的法律责任。问话过程中，鄢某和曾某坚持陈述《水果购销合同》是真实的，双方就缔约过程、付款方式和金额等做了基本一致的完美陈述。在对鄢某问话快要结束时，法官问了鄢某一个问题：你和曾某是微信好友吗？鄢某对法官闲谈式的提问完全没有防备，回答：“是的”。于是法官顺理成章的要求查看鄢某和曾某的微信聊天记录，鄢某脸色微变后表示同意。通过查阅鄢某和曾某的微信聊天记录，法官发现俩人在合同签订前就有密切往来，有报账记录，俩人可能存在合伙或雇佣关系，双方的关系绝非如他们之前向法院陈述仅是单纯的买卖合同关系。在法官的追问下，心虚的鄢某承认其为了多得到货物赔偿款串通曾某签订了假的《水果购销合同》。</span></p><p 15px;'>事实面前，曾某对签订假合同的事也如实交待并承认错误。南丰县人民法院根据查明的事实，酌情考虑俩人承认错误的态度及经济状况等因素对鄢某作出罚款6000元，对曾某罚款4000元的处罚决定。</span></p></section></section></section></section><p><br></p><section ，客观提供诉讼证据材料，任何虚假陈述、隐瞒事实、伪造、篡改证据材料的不诚信行为都将受到法律的制裁。鄢某本是货物损失的受害人，法院将依法审理案件，维护其合法的权利，但鄢某却自作聪明，视法院为“影院”，在法官问话时拙劣“表演＂，想用一份”完美“的假合同蒙骗法官，骗取不法利益，货物损失赔偿款还没得到，反而先为自己的违法行为买单，悔之晚矣！</span></p></section><section style='font-size: 14px;'>对个人的罚款金额，为人民币十万元以下。对单位的罚款金额，为人民币五万元以上一百万元以下。拘留的期限，为十五日以下。被拘留的人，由人民法院交公安机关看管。在拘留期间，被拘留人承认并改正错误的，人民法院可以决定提前解除拘留。</span></p><p style='text-indent: 0em;'><span style='font-size: style='font-size: 14px;'>当事人或者其他诉讼参与人伪造、毁灭证据，提供虚假证据，阻止证人作证，指使、贿买、胁迫他人作伪证，或者对证人、鉴定人、勘验人打击报复的，依照民事诉讼法第一百一十条、第一百一十一条的规定进行处罚。</span></p><p style='text-indent: 0em;'><span style='font-size:
